1. general

these terms and conditions apply to all purchases made through the online shop operated by lilgenau kg, leopoldsgasse 27a, 1020 vienna, austria.

by placing an order through our online shop, you agree to these terms and conditions.

our shop mainly offers carefully selected vintage and pre-owned clothing and accessories. each piece is unique and may show signs of previous wear.

2. products & condition

all items offered by staub.from are vintage or pre-owned unless otherwise stated.

we carefully inspect, clean and describe each item before it is offered for sale. however, vintage pieces may naturally show signs of age, wear or previous use. these may include, but are not limited to, minor fading, small marks, changes in fabric texture or other imperfections consistent with the age and character of the garment.

any significant imperfections known to us will be described in the individual product listing.

please carefully review the product description and images before placing your order.

due to the nature of vintage clothing, each item is generally unique and available only once.

3. prices

all prices displayed in our online shop are stated in euros and include applicable statutory vat, unless otherwise indicated.

shipping costs are shown separately during the checkout process and before the order is placed.

we reserve the right to correct pricing or product information errors. if an obvious pricing error affects an order, we will contact you before processing the order.

4. ordering & contract

by clicking the final order button, you submit a binding offer to purchase the items in your cart.

the purchase contract is concluded when we accept your order by sending an order confirmation by email or by dispatching the ordered goods, whichever occurs first.

after placing an order, you will receive an email confirming the details of your purchase.

we reserve the right to refuse or cancel an order in cases where an item is no longer available, a technical or pricing error has occurred, or there are other legitimate reasons preventing us from fulfilling the order. if payment has already been made, the amount will be refunded in full.

5. payment

we offer the payment methods displayed at checkout.

payment is due immediately upon completion of the order unless otherwise stated.

your order will only be shipped once payment has been successfully received.

6. shipping & delivery

we ship to the countries shown as available at checkout.

available shipping methods, shipping costs and estimated delivery times are displayed during checkout.

delivery times are estimates and may be affected by circumstances outside our control, including delays caused by postal services, customs or other shipping providers.

once an order has been handed over to the shipping provider, we are not responsible for delays caused by the shipping provider.

any applicable customs duties, import taxes or other charges arising in the destination country are the responsibility of the customer.

7. right of withdrawal

if you are a consumer within the meaning of applicable consumer protection law, you generally have the right to withdraw from your purchase within **14 days without giving any reason**.

the withdrawal period begins on the day on which you, or a third party designated by you, receives the goods.

to exercise your right of withdrawal, you must inform us of your decision by a clear statement, for example by email to:

you may also use the online withdrawal function provided in our shop where applicable.

the withdrawal is effective if your withdrawal notice is sent before the withdrawal period expires.

after notifying us of your withdrawal, you must return the goods without undue delay and no later than 14 days after notifying us.

unless otherwise required by law, you are responsible for the direct cost of returning the goods.

we will refund the payments received from you, including the standard delivery costs of the original shipment, within the statutory period. we may withhold the refund until we have received the returned goods or you have provided evidence that the goods have been sent back.

the refund will generally be made using the same payment method used for the original transaction.

you are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

8. returns

returned items must be sent back in the condition in which they were received.

items should be unworn and must not have been washed, altered, damaged or otherwise used beyond what is necessary to inspect and try them on.

for hygiene or other legally permitted reasons, certain items may be excluded from the right of withdrawal where applicable. any such exclusion will be communicated before purchase.

9. statutory warranty

your statutory consumer warranty rights remain unaffected by these terms and conditions.

we are legally responsible for ensuring that goods conform to the contract and applicable statutory requirements.

the fact that an item is vintage or pre-owned does not in itself exclude statutory warranty rights.

however, characteristics or imperfections that have been specifically described in the product listing and expressly agreed as part of the purchase are not considered defects.

nothing in these terms limits any mandatory consumer rights applicable under law.

10. availability & unique pieces

many of our products are one-of-a-kind vintage pieces.

if an item becomes unavailable due to an inventory error or another circumstance beyond our reasonable control, we may cancel the affected order and refund any payment already received.
11. intellectual property

all content on the staub.from website, including photographs, texts, logos, graphics and other materials, is owned by or licensed to lilgenau kg and may not be reproduced, distributed or used without prior written permission.

12. liability

we are liable in accordance with applicable statutory law.

nothing in these terms excludes or limits liability where such exclusion or limitation is not permitted by law.

13. applicable law

these terms and conditions are governed by the laws of austria, to the extent permitted by applicable mandatory consumer protection law.

if you are a consumer residing in another country, mandatory consumer protection provisions of your country of residence that cannot be contractually excluded remain unaffected.

14. alternative dispute resolution

we aim to resolve any concerns directly and amicably. please contact us at hi@curatedbystaub.com before pursuing further remedies.

consumers may also have access to statutory alternative dispute resolution or other consumer protection mechanisms available in their country of residence.
